Ownership
In compliance with Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE), we hereby inform you preventing that ownership of the domain of our online store, www.DEYUTE.com, belongs to De Yute Fabrics, S.L., a company legally incorporated in Spain with Tax ID (CIF) B13983218 and registered with the Alicante Companies Registry on 26/06/2023, Volume 4,619, Page 30, Sheet A-188,021, Entry 1 (hereinafter DEYUTE).
Purpose and scope of application
These Legal Terms or General Terms and Conditions of Contracting are intended to regulate the availability of the information provided on DEYUTE, as well as the commercial transactions that may arise between DEYUTE and users of the domain www.DEYUTE.com.
Both browsing the online store and understanding and purchasing any of the products offered therein imply acceptance, as a user, without reservations of any kind, of each and every one of these general terms and conditions of contracting and use.
DEYUTE may at any time, and without prior notice, modify these general terms and conditions of contracting and use, as well as any specific terms that may be included, by publishing such modifications in the store so that users may be aware of them, and keeping record of the date of such modifications.
Order validation by the customer expressly implies knowledge and acceptance of these general terms and conditions of contracting as part of entering into the contract. Unless proven otherwise, the data recorded by DEYUTE constitutes proof of the set of transactions carried out between DEYUTE and its customers. DEYUTE will store the electronic document in which the contract is formalized, and it will be accessible to the user.
Once the purchase has been made and as soon as possible, always before 24 hours have elapsed from the completion of the purchase, DEYUTE Customer Service will send the customer a purchase receipt by email. If the customer does not agree with the information contained in said confirmation, they may request that it be amended or that the contract be cancelled.
Information
Every effort is made to ensure that the information contained on the website is accurate and free of typographical errors. Should any such error occur at any time, beyond the control of DEYUTE, it will be corrected immediately.
If there is a typographical error in any of the prices shown and a customer has made a purchase decision based on such error, we will inform the customer of the error and the customer will have the right to cancel the purchase at no cost.
Likewise, the content on the website may occasionally display provisional information about certain products. If the information provided does not correspond to the product’s characteristics, the customer will have the right to cancel the purchase at no cost.
Intellectual Property
All content published in the store, and especially designs, texts, graphics, logos, icons, buttons, as well as software, trade names, trademarks or industrial designs, and any other signs susceptible to industrial and commercial use, are subject to intellectual and industrial property rights of DEYUTE or of third parties who have duly authorized their inclusion on the website. In no case shall it be understood that any license is granted or that any waiver, transfer, assignment, in whole or in part, of such rights is made, nor is any right or expectation of right conferred, and in particular, no right of alteration, exploitation, reproduction, distribution, or public communication of said content is granted without the prior express authorization of DEYUTE or the corresponding rights holders.
Liabilities
The products presented on the website comply with Spanish legislation. The liability of DEYUTE may not be invoked in the case of products that do not comply with the legislation of the countries to which they may have been shipped based on the customer’s order. It is therefore the responsibility of customers outside Spain to verify the possibility of importing or using the products they request.
The user assumes full responsibility arising from the use of our website and is solely responsible for any direct or indirect effect derived therefrom, including, by way of example and not limitation, any adverse economic, technical and/or legal result, as well as the frustration of expectations generated by our website, and the user undertakes to hold DEYUTE harmless from any claims arising directly or indirectly from such facts.
DEYUTE shall not be liable for damages that may arise from interference, omissions, interruptions, computer viruses, breakdowns and/or disconnections in the operational functioning of this electronic system or in users’ computer equipment and devices, due to causes beyond DEYUTE’s control, that prevent or delay the provision of services or browsing of the store; nor for delays or blockages in use caused by deficiencies or overloads of the Internet or other electronic systems; nor for the impossibility of providing the service or allowing access due to causes not attributable to DEYUTE, due to the user, third parties or force majeure. DEYUTE does not generally control how users use the website and does not guarantee that they will use it in accordance with the law, these General Terms and Conditions, morality, generally accepted good customs, and public order, nor that they will do so diligently and prudently.
Users’ Obligations
In general, the user undertakes to comply with these general terms and conditions, as well as with any special warnings or instructions for use contained herein or on the website, and to always act in accordance with the law, good customs and the requirements of good faith, exercising due diligence, and refraining from using the website in any way that may prevent, damage or impair its normal operation, the assets or rights of DEYUTE, its suppliers, other users or, in general, any third party. DEYUTE is not responsible for the truthfulness and accuracy of the data entered by the user.
In particular, the user undertakes to:
- a) Provide truthful information about the data requested in the user registration or order form, and keep it updated.
- b) Not introduce, store or disseminate on or from the website any information or material that is defamatory, insulting, obscene, threatening, xenophobic, incites violence, discrimination based on race, sex, ideology, religion, or that in any way violates morality, public order, fundamental rights, public freedoms, the honor, privacy or image of third parties, and in general current legislation.
- c) Not introduce, store or disseminate through the store any program, data, virus, code or any other electronic or physical device that may cause damage to the website, any of the services, or any equipment, systems or networks of DEYUTE, of any other user, of DEYUTE’s suppliers or, in general, any third party.
- d) Diligently safeguard the “username” and “password” provided by DEYUTE, assuming responsibility for any damages that may result from their improper use.
- e) Not carry out advertising or commercial exploitation activities through the website, nor use its content and information to send advertising or messages for any other commercial purpose, or to collect or store personal data of third parties.
- f) Not use false identities, nor impersonate others in the use of the website or any of its services, including the use of third-party passwords or access keys.
- g) Not destroy, alter, use for personal purposes, render unusable or damage the data, information, programs or electronic documents of DEYUTE, its suppliers or third parties.
- h) Not introduce, store or disseminate through the store any content that infringes intellectual property rights, industrial property rights or trade secrets of third parties, nor any content that the user does not have the legal right to make available to third parties.
The customer undertakes to facilitate delivery of the order by providing a delivery address where it can be delivered during normal goods delivery hours. If the customer fails to comply with this obligation, DEYUTE shall have no liability for any delay or inability to deliver the order requested by the customer.
Privacy and Personal Data Protection
For the purposes of Organic Law 15/1999 of December 13 on the Protection of Personal Data, as well as Royal Decree 1720/2007 of December 21 approving the regulation implementing Organic Law 15/1999, DEYUTE informs users of the existence of a personal data file created by and under the responsibility of De Yute Fabrics, S.L. with the data obtained on the DEYUTE website.
The purpose of this file is to manage the contractual relationship with customers, as well as to carry out promotional and advertising activities through any means, including the sending of commercial messages via SMS, email and postal mail that may be of interest to users, based on the study and segmentation of data collected during browsing of the website, data provided through any form, as well as data derived from the commercial relationship or delivery of purchased products.
Unless otherwise indicated in the relevant fields, answers to questions and/or requests for personal data are voluntary, and the lack of response will not imply a reduction in the quality or quantity of the corresponding services, without prejudice to any activation that DEYUTE may require.
In compliance with Organic Law 15/1999, customers and users of DEYUTE may at any time exercise their rights of access, rectification, cancellation and objection regarding their personal data by notifying in writing: De Yute Fabrics, S.L., Customer Service Department, Carretera Nacional 340 Murcia-Alicante, Km 51,500. Partida Llano San José. Polígono 1, Nave 8, Elche 03293 (Alicante), or by email to info@deyute.com, indicating name and surname, username and email used to register, and attaching a photocopy of the national ID document.
If the data provided is associated with a purchase, Spanish law requires that it be retained for at least six years, and therefore it cannot be deleted or rectified even if the customer requests it.
DEYUTE undertakes to respect the confidentiality of the data included in the file and to use it in accordance with the purpose of the file, as well as to comply with its obligation to store it and implement all measures to prevent alteration, loss, unauthorized processing or access, in accordance with the Security Measures Regulation for automated files containing personal data, approved by Royal Decree 994/1999 of July 11.
DEYUTE may disclose personal data in compliance with a court order or competent administrative authority, as well as in cases of threats to the security of the site, the user, ourselves or third parties. Use of the website implies acceptance of our Privacy Policy. If the user does not agree with this policy, please do not use the website.
DEYUTE reserves the right to modify this policy to adapt it to legislative or case-law developments, as well as to industry practices. In such cases, DEYUTE will announce the changes on the site, which will take effect from their online publication. To use our website, cookies are required. Cookies are used to personalize and improve your visit to the DEYUTE website. If you wish, you can configure your browser to notify you of the receipt of cookies and to prevent their installation. Availability
The selection of products offered on DEYUTE is valid as long as the products are visible on the website, within the limits of available stock. If the goods are in stock, the approximate timeframe is 2 to 3 days within Spain (mainland). If, on the contrary, we do not have stock, the approximate timeframe is 15 business days, to which the delivery times of the transport companies must be added. These timeframes are calculated on business days (Monday to Friday), since DEYUTE does not ship on public holidays, Saturdays, or Sundays. The stated dispatch times are indicative. In the event of out-of-stock or temporary unavailability, DEYUTE will contact the user to inform them of a new delivery timeframe or, if it is not possible to supply the product, to proceed with cancellation. In any case, a delay in delivery compared to the indicated timeframes will not entitle the customer to claim any compensation.
Shipping
Products are shipped to the shipping address indicated in the order. If an order includes several items with different availability, the dispatch timeframe will be based on the longest estimated delivery time. In exceptional cases, DEYUTE reserves the right to split the order, shipping available items and leaving unavailable items for a second shipment. In such case, the second shipment will be made at no additional cost.
We work with specialized courier companies for transport and delivery. Deliveries are not made on Saturdays, Sundays, or public holidays. If the customer notices any problem at the time of delivery (damaged packaging, missing or damaged products), they must state it in writing on the carrier’s delivery note and contact our Customer Service center by phone (96 668 04 55) within the first 24 hours after receipt.
No returns of damaged items, nor claims for missing items, will be accepted if they are not communicated within the established time period.
Payment
At DEYUTE, we offer various payment methods to ensure a convenient, secure, and reliable shopping experience. By placing an order on our website, you accept the following terms related to payment methods:

Declined payments
If a payment is not approved, the order will not be processed. In such case, you will receive a notification with options to resolve the issue, such as trying another payment method or contacting your bank or financial service provider.

Returns
In order to make a return, you must first contact our Customer Service Department by phone at 96 668 04 55 or through the contact form, so that we can send you a return authorization, which you must duly complete and include with the item to be returned.
The maximum period to request a return is 15 calendar days from receipt of the order. The item(s) must be in the same condition as received, including the original packaging.
Once we verify that the item and its packaging are in proper condition, we will proceed to refund the amount of the product or send you a replacement, as you indicate, excluding transport costs, which are non-refundable. The shipping cost of the replacement product will be calculated as a new order. The refund will be made using the same payment method used for the purchase.
DEYUTE will not refund any amount nor reship any goods until receipt and the condition of the packaging and accessories of the returned or exchanged item have been verified in our warehouses. The amount to be refunded is the price originally shown on the order.
Once the correct condition of the returned product has been verified, DEYUTE will proceed with the refund within a maximum period of 365 days. In the case of out-of-stock orders placed at the customer’s express request, returns will not be possible.
Applicable Law
Purchases made on DEYUTE are subject to Spanish law. In the event of any conflict or discrepancy in the interpretation or application of these contractual terms, the Courts and Tribunals with jurisdiction will be guaranteed by the applicable legislation on competent jurisdiction.
Pursuant to Article 16 of Council Regulation (EC) No 44/2001, legal action brought by a consumer against the other contracting party may be filed either in the courts of the Member State in which that party is domiciled or in the courts of the place where the consumer is domiciled. Legal action brought against the consumer by the other contracting party may only be filed in the courts of the Member State in which the consumer is domiciled.
